This Privacy Policy applies to personal information collected online by Bollé Safety Inc. and its affiliates and brands, including Bollé Safety (collectively, “Bollé Safety”, “we”, “our”, or “us”) on the Bollé Safety “Safety RX Program” webshop (The “Webshop”). We do not knowingly collect or maintain personal information provided by children under the age of 13 without the consent of a parent or guardian.

 

1. What information do we collect about you on the Webshop?

We may collect information about you from a variety of sources, including when you provide us information, when we observe or collect information through technology, and when we receive information about you from third parties.

We and our service providers may utilize cookies and other technologies, such as pixels and web beacons (also known as “clear gifs” and “pixel tags”) to recognize you, perform analytics, customize your experience, and serve advertisements. Cookies are very small files placed on your computer, and they allow us to count the number of visitors on the Webshop, distinguish repeat visitors from new visitors, improve our marketing, and perform analytics. They also allow us to save user preferences and track user trends and activity.

d. Fitting Services. We provide services to individuals through the Webshop that allow an individual to fit their prescription lenses by using a pupillary distance measurement and virtual “try-on” functions (the “Fitting Services”). The information that we receive from individuals who receive the Fitting Services may include protected health information that is subject to certain confidentiality protections under the Health Insurance Portability and Accountability Act of 1996, as amended by its implementing regulations (“HIPAA”). In addition to this Privacy Policy, our Notice of Privacy Practices also contains information that explains how we may use or share any protected health information that we receive in connection with the Fitting Services.

Information Obtained from Third parties

We may combine information about you from other sources with the information we have collected about you on our Webshop with information we obtain from third parties, such as your company, our affiliates and related companies, information available in the public record, or a participating insurers or eye care professional. The information obtained from third parties is similar to the information identified in the “Information you Provide” section above.

 

2. How do we use the information we collect about you?

The information we learn from you helps us personalize your experience with us and our communications to you and helps us continually improve your experience on our Webshop.

We use the information we collect about you for things like:

• servicing our customers

• advertising and marketing, including emails and postal mail

4. What choices do you have over how we use your information?

We give you choices about the information we collect and how we communicate with you.

1. Email: You may opt-out of our marketing emails by following the instructions listed in the email that you received. However, even if you opt-out you may still receive non-marketing emails, such as customer service communications.

 

2. Location Information:

a. Mobile Device Location Information. Your mobile device settings may allow you to disable location-based services, which will prevent our Webshop from accessing your precise mobile device location information. We recommend you review the help or user manual provided with your device for instructions.

b. Desktop Device Location Information. Your desktop web browser may allow you to remove permission you granted through your desktop device for our Webshop to access your location information and/or completely block requests for location information. We recommend you review the help or user manual provided with your browser for instructions.

c. Email Location Information. Your email program may allow you to prevent the pixel tags or images in the emails you receive from us from downloading, which will also prevent our service provider from accessing your location information. You can also unsubscribe from receiving our emails, as described in the “Email” section above.

Cookies and Similar Technologies: If you do not want us to deploy cookies in your browser, you may be able to opt out by setting your browser to reject cookies or to notify you when a website tries to put a cookie in your browser software. If you choose to disable cookies in your browser, you can still use the Webshop, although your ability to use some of the features may be affected. You should also note that our systems may not recognize “Do Not Track” headers from some or all browsers.

California Opt-Out Rights: Under California law, if you are a resident of California and have previously communicated with us, you may make a written request to us about how we have shared your personal information during the prior calendar year with third parties for their direct marketing purposes. In response to your written request, we are allowed to provide you with a cost-free means to opt-out of such sharing rather than providing the information about these third parties. you can do by submitting an opt-out request via email to gdpr@bollebrands.com. This email should include your name, all of the postal addresses and email addresses that you have provided to us, and a request to opt-out of sharing your personal information.

 

5. How do we secure your information on our Webshop?

Our Webshop utilizes commercially reasonable precautions, including, encryption technology, firewalls, and other reasonable technical, administrative and physical measures designed to protect the personal information in our custody or control from unauthorized access, use, modification and disclosure. Moreover, we regularly make our best effort to monitor our systems for possible vulnerabilities and attacks. While we implement these security measures on our Webshop, you should be aware that 100% security is not always possible.

We may enable you to navigate to third-party websites through links on our Webshop. We do this for your convenience. If it is not one of our websites, we do not endorse, may not have any affiliation with, do not control and aren’t responsible for those third-party websites and/or their Internet and web practices. Whether the third-party content appears within our Webshop environment (like a map frame), or you leave our Webshop for another website to view it, the terms, conditions, and privacy policies of those other websites govern your online experience. We may make changes to this Privacy Policy at any time, so please review it periodically. We will update the effective date of the Privacy Policy at the time a change is made.

 

7. How do you handle biometric information?

We provide a virtual try-on tool for your convenience. The virtual try-on tool uses augmented reality technology to allow you to “try on” certain of our products, such as sunglasses, virtually, in order to get an idea of what the product would look like on your face in real life. We do not store any biometric information when you use the virtual try-on tool.

The virtual try-on tool functions in real-time on your device. The tool works by processing the image you upload through your webcam by utilizing an AI algorithm to identify the position of different key features on the image of your face—such as your eyes, ears, and nose. The algorithm then positions a box over the image of your face, allowing the application to position a digital image of the selected eyewear product on top of the image of your face to make it appear as if you are wearing the selected eyewear product.

During your virtual try-on session, no information or data relating to your face are sent to or from any external servers. The virtual try-on tool does not store, obtain, or transmit any retinal scans, facial geometry, or other biometric data externally, and does not have the ability to store, obtain, or transmit any retinal scans, facial geometry, or biometric data externally. selected eyewear products on top of your face is all completed locally on your browser session, with no collection, preservation, storage, or transmittal of any facial data outside of your browser.
