We require all our service and third party providers to respect the security of your personal information and to treat it in accordance with the law and only permit them to process your personal information for specified purposes and in accordance with our instructions. We request that the persons authorized to process your personal information have committed themselves to confidentiality and that they implement technical and organizational measures to ensure a good level of security.

Moreover, where your personal information must be processed by service or third party providers acting as autonomous data controllers (e.g. payment service providers), we undertake to ensure that their compliance with the applicable laws regarding personal information is one of our selection criteria for said service providers.

Sharing your personal information outside of Australia and New Zealand

We share, send and store your personal information outside of Australia and New Zealand, predominantly to our affiliates in the Bolle Safety worldwide group of companies, and primarily located in the United States of America, the United Kingdom and the European Economic Area (“EEA”) of the European Union.

Where we share, send and store your personal information outside of Australia and New Zealand, we will make sure that it is protected in substantially the same way as it is within Australia and New Zealand, and will implement appropriate safeguards to seek to protect your privacy

 

How long do we store your personal information?

We will keep your personal information for as long as you are a customer of Bolle Safety.  The points below show how long we typically keep such information, and our reasons why. We will store your personal information for as long as necessary to fulfil the purposes described in this Privacy Policy.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements. 

These are the main criteria that we use to determine when we will delete your personal information:

• We retain Order information for as long as you have an account on the Website, and to the extent required by law (such as tax/bookkeeping laws), which may vary from one country to the other. In Australia and New Zealand, your personal information will be stored for at least 7 years.  Within the Bolle Safety worldwide group of companies, your information may be stored for 10 years.

• We retain personal information such as Contact information, Profile information, Order information and Communication information, where needed, to the extent relevant for limitation periods for potential claims (typically six years after date of purchase).

• We retain personal information such as Contact information, Order information, Marketing information, and Preference information for as long as you have consented to receive marketing communication from us. If you have never ordered anything on our Website, your personal information is stored for a maximum of 3 years as from your last contact with us (by sending us an email or clicking on a link in an email we send for instance). 

• In some circumstances we will anonymise your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

 

Protecting your personal information

The security of your personal information is a key concern to us. We are taking great care for the choice of our IP devices, software, our subcontractors and for improving our internal processes. We take and require that our subcontractors take, appropriate technical and organizational measures to protect your personal information, prevent loss, destruction, unauthorized or unlawful access and use of your personal information. In addition, we limit access to your personal information to those employees, affiliates, distributors, agents, licensors, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality.

Your personal information may be held and stored on paper, by electronic means, or both.  We will take reasonable steps and will use secure methods to destroy or to permanently de-identify your personal information when it is no longer required for any purpose for which the personal information may be used under this Privacy Policy and otherwise in accordance with applicable privacy laws and regulations.  As an example, our destruction and de-identification methods may include:

• Paper records being placed in security bins and shredded; or

• Electronic records being deleted from all locations to the best of our ability, or encrypted and/or placed beyond use.

• Personal information held and stored on paper being stored in lockable filing cabinets. 

• Business premises having secured entry and monitored alarms.

• Personal information held and stored electronically, including “in the Cloud”, being protected by internal and external firewalls, limited access via file and network passwords, files being designated ‘read-only’ or ‘no access’ etc. 

• Requiring our IT contractors and other third parties to implement privacy safeguards.

While we have put in place appropriate security measures to protect your personal information, please note that no electronic transmission or storage information is 100% secure and that we cannot guarantee that loss, destruction, unauthorized or unlawful access and use of your personal information will never occur.

Where it is ascertained that a breach has actually occurred and where required by law, we will notify the OAIC and/or the OPC (as relevant), and affected individuals as soon as practicable after becoming aware that a data breach has occurred.
